Preliminary injunction filed in the U.S against loss of 100k employment-based green cards

The 125 plaintiffs including Indians have filed a preliminary injunction in the U.S distinct court against the possibility of wasting almost 100k employment-based green cards .

Earlier, it was reported that about one lakh employment-based green cards were at the risk of being wasted in less than two months. It caused big resentment among Indian IT professionals whose wait for legal permanent residency now runs into decades, a PTI report said.

This year’s quota for employment-based immigrants is 261,500, far higher than the usual 140,000, Indian professional Sandeep Pawar told PTI.

Now the preliminary injunction filed in the district court states “The court should issue a preliminary injunction requiring defendants (USCIS) to adjudicate the plaintiffs’ ‘Adjustment of Status’ applications by September 30, 2021.

“In the alternative, the court should issue a preliminary injunction ordering defendants to consider a visa number ‘reserved’ at the time an applicant files her I-485, such that plaintiffs’ cases can be adjudicated in fiscal year 2022,” it said.

A lawsuit filed regarding this issue has been pending in the courts.
