Trump Admin’s H-1B wage hike rule under review, may not be taken up in this filing season for implementation

Trump administration’s final H-1B visa wage rule may not come into force in this filing season, which is going to start in March, as U. S president Joe Biden has put it under review.
The rule which was issued by Trump admin in the federal register was expected to take effect from March. But due to the new President’s decision it may only come in to force on May 14, if only it is approved.
“This proposed delay of 60 days will allow agency officials the opportunity to review any questions of fact, law, or policy, the rule may raise,” says the US department of labour (DOL). Meanwhile, DOL will be seeking public comments on this extension, a Times of India report said.
As promised,hours after getting sworn in as president of the United States, Joe Biden had reversed some of the decisions made by Trump administration regarding H-1B visa program.
The White House Chief of Staff, in a memorandum, said all the rules published by Department of Labor (DOL) in the Federal Register, but not taken effect, will be postponed for 60 days. Rules that have not been published in it will be withdrawn immediately for review and approval.
As per the memorandum, the skill-based selection process by Trump admin became void until May 14.
As per the wage and skill-based selection process employers may have to offer higher salaries for higher-skilled positions and establish a more certain path for businesses to achieve personnel needs and remain globally competitive.
